These Terms apply to the PetMeds website and app, accounts, ordering flows, AutoShip, promotions, giveaways, and related online services, together with additional terms presented at checkout, during AutoShip enrollment, in promotional materials, in product notices, and in the PetMeds Privacy Policy. By creating an account, placing an order, enrolling in AutoShip, entering a promotion or giveaway, submitting content, or otherwise using the PetMeds website or app, you agree to these Terms. If you do not agree, do not use the PetMeds website or app, place orders, enroll in AutoShip, or participate in promotions or giveaways.
You are responsible for your account credentials and all account activity and must keep account, shipping, prescription, and payment information accurate and current. PetMeds may suspend access, cancel orders, or decline benefits for suspected misuse, duplicate promotional accounts, fraud, Terms violations, or unlawful activity.
Prescription products may be dispensed only after PetMeds Pharmacy, LLC or another dispensing pharmacy receives and verifies a valid prescription from a licensed veterinarian or authorized prescriber. PetMeds may contact the prescriber, request information, delay shipment, make lawful substitutions consistent with prescription instructions, or cancel any order that cannot be verified, completed, or lawfully dispensed or shipped.
Availability, refill authorization, dosage form, quantity, substitution, compounding, controlled-substance handling, temperature-sensitive handling, shipping eligibility, pharmacist support, and pharmacy contact options may vary by product, prescriber instruction, pharmacy policy, and law. PetMeds may refuse or cancel orders that cannot be filled, shipped, or delivered accordingly, and customers must provide accurate prescriber, pet, patient, shipping, and contact information and respond to verification or safety requests.
Content on the PetMeds website or app and in customer communications is for general informational purposes only and is not veterinary advice, diagnosis, or treatment. Consult your veterinarian about your pet’s health, medications, dosage, side effects, interactions, and product suitability, and contact a veterinarian, emergency veterinary clinic, or emergency service immediately in an emergency.
PetMeds strives to provide accurate product, pricing, availability, promotion, shipping, and educational information, but errors, omissions, delays, and changes may occur. PetMeds may correct information, limit quantities, discontinue products, reject or cancel orders, or request more information before acceptance or fulfillment; if payment has been collected for a canceled order, PetMeds will provide any refund or credit required by law and PetMeds policies.
PetMeds will maintain appropriate support for objective advertising claims, especially health-related, savings, efficacy, comparative, and testimonial claims. No employee, affiliate, influencer, participant, or customer may make product claims that are false, misleading, unsupported, inconsistent with approved labeling, or unlawful.
If you submit ratings, reviews, testimonials, photographs, videos, comments, social media posts, feedback, questions, or other content (“User Content”) to or about PetMeds, you represent that it reflects your honest opinions, findings, beliefs, or experiences and is not false, misleading, unlawful, confidential, private, infringing, threatening, harassing, obscene, vulgar, sexually explicit, discriminatory, or irrelevant. You may not submit fake reviews, undisclosed third-party reviews, undisclosed paid or incentivized reviews, or content that misrepresents your relationship with PetMeds.
PetMeds may moderate, reject, remove, or decline to display content that violates these Terms or law, but will not use these Terms to prohibit or penalize honest reviews or opinions. By submitting content, you grant PetMeds a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, display, distribute, adapt, and create derivative works from the content for PetMeds products, services, marketing, promotions, and business operations, subject to applicable law and privacy obligations.
PetMeds may send transactional or relationship communications about accounts, orders, prescriptions, AutoShip, shipping, safety, recalls, returns, customer service, and policy changes. Marketing emails will be sent only as permitted by law, will include required opt-out mechanisms, and PetMeds will honor opt-outs within the legally required period, although transactional or relationship messages may continue.
If PetMeds offers text message programs, any legally required consent must be obtained before marketing texts, and marketing-text consent is not a purchase condition. You may revoke consent or opt out of robocalls or robotexts at any time and in any reasonable manner, including by replying STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE where supported; PetMeds will honor do-not-call and revocation requests within the legally required period.
Returns, refunds, replacements, substitutions, and credits are subject to the PetMeds Return Policy and applicable law. Prescription, temperature-sensitive, opened, compounded, controlled-substance, personalized, and safety- or regulatory-restricted products may be ineligible for return, refund, replacement, or resale except as required by law or PetMeds policy. Contact PetMeds promptly if an order arrives damaged, incomplete, incorrect, expired, compromised, or otherwise inconsistent with PetMeds policies.
PetMeds may modify, suspend, or discontinue all or any part of the website, app, content, account features, ordering flows, AutoShip, promotions, giveaways, or related online services at any time, subject to applicable law and any material terms that PetMeds presents for a specific product, service, order, promotion, or program. You are responsible for using reasonable security measures and for ensuring that your device, browser, network, and software are compatible with and secure for accessing the website and app.
The PetMeds website and app may contain links, integrations, payment tools, shipping tools, social media features, advertising, product information, manufacturer materials, or other content, services, or functionality provided by third parties. PetMeds is not responsible for third-party websites, services, platforms, content, policies, practices, availability, security, errors, or omissions, and your use of third-party services may be subject to separate terms and privacy policies.
EXCEPT FOR WARRANTIES THAT PETMEDS EXPRESSLY PROVIDES IN WRITING AND ANY WARRANTIES THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW, THE PETMEDS WEBSITE, APP, CONTENT, ACCOUNTS, ORDERING FLOWS, AUTOSHIP, PROMOTIONS, GIVEAWAYS, CUSTOMER COMMUNICATIONS, AND RELATED ONLINE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, PETMEDS AND ITS AFFILIATES, LICENSORS, SUPPLIERS, SERVICE PROVIDERS, AND PHARMACIES DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND ERROR-FREE OR UNINTERRUPTED OPERATION. Nothing in these Terms excludes, limits, or modifies any warranty, remedy, right, or liability that cannot be excluded, limited, or modified under applicable law, including any rights under applicable consumer-protection, pharmacy, prescription-drug, product-liability, or animal-health laws.
TO THE FULLEST EXTENT PERMITTED BY LAW, PETMEDS AND ITS AFFILIATES, LICENSORS, SUPPLIERS, SERVICE PROVIDERS, PHARMACIES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR MULTIPLE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, PERSONAL INCONVENIENCE, OR COST OF SUBSTITUTE GOODS OR SERVICES, ARISING OUT OF OR RELATED TO THE PETMEDS WEBSITE, APP, CONTENT, ACCOUNTS, ORDERS, AUTOSHIP, PROMOTIONS, GIVEAWAYS, CUSTOMER COMMUNICATIONS, PRODUCTS, SERVICES, OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, STATUTE, STRICT LIABILITY, NEGLIGENCE, OR ANY OTHER LEGAL THEORY, EVEN IF PETMEDS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, PETMEDS’ TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE PETMEDS WEBSITE, APP, CONTENT, ACCOUNTS, ORDERS, AUTOSHIP, PROMOTIONS, GIVEAWAYS, CUSTOMER COMMUNICATIONS, PRODUCTS, SERVICES, OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO PETMEDS FOR THE PRODUCT, ORDER, AUTOSHIP SHIPMENT, OR SERVICE GIVING RISE TO THE CLAIM OR ONE HUNDRED DOLLARS ($100). THE FOREGOING LIMITATIONS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE AND DO NOT LIMIT LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless PetMeds and its affiliates, licensors, suppliers, service providers, pharmacies, officers, directors, employees, agents, and representatives from and against claims, losses, liabilities, damages, fines, penalties, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your misuse of the PetMeds website or app, violation of these Terms or law, account activity, inaccurate or unauthorized prescription, pet, patient, shipping, payment, or account information, submissions or User Content, or infringement or violation of any rights of another person or entity. PetMeds may control the defense of any matter subject to indemnification, and you must cooperate with that defense.
By signing up for AutoShip & Save, you agree to these Terms for our AutoShip subscription ordering program ("AutoShip"). Use of the PetMeds website or app is also governed by these Terms of Use, the Privacy Policy, and other terms presented on the PetMeds website or app, as changed over time and subject to applicable law. By placing an order and enrolling in AutoShip, you accept those terms. These Terms constitute the entire agreement between you and PetMed Express, Inc. and, for prescription products, PetMeds Pharmacy, LLC (together, "PetMeds”), relating to AutoShip.
By purchasing product(s) from PetMeds and enrolling in AutoShip, you authorize PetMeds to create recurring orders and ship selected products at your chosen delivery frequency until you cancel or the subscription otherwise terminates. You may change delivery frequency, shipping address, payment method, and included products through available account-management tools or customer service channels. AutoShip discounts apply only to eligible shipments and are subject to product availability, promotion terms, prescription requirements, and law.
PetMeds may change AutoShip terms, discounts, eligibility, prices, taxes, shipping charges, product eligibility, prescription requirements, and other offer details, subject to any notice or consent required by law. PetMeds will not change the price of your first shipment after you authorize the order, and will disclose the then-current price for later shipments in the pre-shipment notice or other legally required notice before shipment. PetMeds may terminate AutoShip if selected goods are unavailable or cannot be lawfully dispensed or shipped.
Your AutoShip subscription will continue until canceled or terminated under these Terms. Before enrollment, PetMeds will present the material AutoShip terms, obtain your affirmative consent before charging your payment method, provide a retainable acknowledgment describing the AutoShip offer terms, cancellation policy, and how to cancel, and maintain consent records as required or permitted by law. PetMeds also will provide any legally required renewal, annual reminder, trial-conversion, price-change, or other material-change notices together with any required cancellation instructions.
When you place your initial order and enroll in AutoShip, PetMeds will create your subscription, provide the acknowledgment described above, and process your first order immediately. Your selected payment method will be charged when that initial order is placed. After the first order, AutoShip will automatically create a new order according to your selected delivery frequency unless and until you cancel or the subscription is otherwise terminated under these Terms.
For each AutoShip order after the first order, PetMeds will send a pre-shipment email notice up to 96 hours before the scheduled ship date identifying the AutoShip item(s), current price(s), scheduled ship date, and the period during which you may change or cancel the upcoming order. Unless otherwise stated in the notice, you may change the delivery frequency, shipping address, payment method, or included products, or cancel the upcoming order, beginning when the notice is sent and ending at 12:00 AM on the day before the scheduled ship date.
If you do not cancel by that deadline, you authorize the upcoming order. Approximately 24 hours before the scheduled ship date, PetMeds may place a payment authorization hold on the payment method associated with the subscription or any updated payment method you provide. The authorization hold is not an actual charge, but it may affect available credit until the order is processed. If you submit a cancellation or change request after the applicable deadline, PetMeds may be unable to stop or revise an order already in process, and any shipped order will remain subject to the PetMeds Return Policy and applicable law. You may cancel AutoShip at any time for future orders by clicking the Cancel button on 1800PetMeds.com, through Manage AutoShip in Your Account, through any other online cancellation mechanism PetMeds makes available, or by calling Customer Service at 800-738-6337. PetMeds will not impose unreasonable or unlawful cancellation conditions and will process cancellation requests as required by law.
By enrolling in PetMeds AutoShip and providing a credit or debit account number, including any substitute account you later provide or your financial institution supplies (“Payment Method”), you authorize PetMeds to charge the Payment Method on a recurring basis in the amounts noticed for AutoShip orders. You represent that the Payment Method is legitimate, active, and authorized for your use, and that this authorization remains effective until you withdraw consent or the Payment Method expires
If a charge is refused or dishonored, the amount due is immediately payable and PetMeds may cancel AutoShip if payment is not made.
If an authorized payment date falls on a weekend or holiday, payment may be processed on the next business day, and funds may be charged as soon as the noticed transaction date. Rejected payments may be subject to an NSF fee of up to $25, to the extent permitted by applicable law, which you authorize PetMeds to charge through a separate transaction. PetMeds may retry a rejected or unsuccessful charge up to two times and is not liable for fees imposed by your financial institution.
If PetMeds or its payment processor makes a payment-processing error, you authorize PetMeds to correct it by crediting or debiting the Payment Method for the amount of the error and to verify or correct missing or erroneous Payment Method or financial-institution information.
PetMeds may submit periodic AutoShip charges to your chosen Payment Method until you cancel or change that Payment Method. About 24 hours before the scheduled ship date, PetMeds may place an authorization hold, which is not an actual charge but may reduce available credit until the order is processed.
The origination of electronic transactions must comply with the provisions of U.S. law and applicable card network rules. Each payment will be processed in U.S. dollars, and, if it is converted into another currency, its amount may vary based on fluctuations in the applicable conversion rate.
For each AutoShip shipment, the charge will be the price stated in the pre-shipment email or other legally required notice, less applicable discounts, plus applicable shipping charges and sales tax. Your Payment Method will be charged when the order ships, and any available 1800PetMeds.com account credit may be applied first.
Each AutoShip shipment will be billed to the Payment Method used to create the subscription or another Payment Method you direct. If PetMeds cannot complete an AutoShip order using the current Payment Method, PetMeds may notify you and provide an opportunity to add or update a Payment Method for that order.
Your subscription remains in effect until canceled. Cancellation mechanics are described above. These Terms do not limit any federal right to stop payment of a preauthorized electronic transfer through your financial institution, and you must notify PetMeds of Payment Method changes or authorization termination at least three (3) days before your next billing date.
We may change these Terms and applicable 1800PetMeds.com terms from time to time, subject to applicable law. PetMeds will give legally required notice of material AutoShip changes, including material price, cancellation, and other noticed changes. If any change is invalid, void, or unenforceable, it is severable and the remaining changes and conditions remain valid. YOUR CONTINUED PARTICIPATION AFTER REQUIRED NOTICE AND THE EFFECTIVE DATE CONSTITUTES ACCEPTANCE. IF YOU DO NOT AGREE, YOU MUST CANCEL YOUR SUBSCRIPTIONS.
We may terminate subscriptions at any time, subject to applicable law, and will charge only for shipped orders. Products ship only within the forty-eight (48) contiguous U.S. states unless PetMeds states otherwise. AutoShip participation is personal and may not be assigned or transferred without authorization. AutoShip returns are subject to the PetMeds Return Policy and applicable law. AutoShip is void where prohibited.
Except where prohibited by law, disputes arising from the PetMeds website or app, account, order, AutoShip subscription, promotion, giveaway, product, communication, or these Terms will proceed only individually, not as a class, collective, consolidated, private attorney general, or representative action. Either party may bring a qualifying individual claim in small claims court or seek temporary or preliminary injunctive relief to protect intellectual property, confidential information, or account security.
Before arbitration or litigation, the asserting party must give written notice describing the dispute and requested relief, and the parties will try in good faith to resolve it informally for at least thirty (30) days. If unresolved and the applicable Terms of Use require arbitration, the dispute will proceed in individual binding arbitration under those procedures, subject to applicable rights, limits, exceptions, opt-outs, and law.
Promotions, sweepstakes, contests, coupons, discounts, giveaways, and similar offers may be governed by separate offer terms, campaign terms, or official rules provided with the applicable promotion. If there is a conflict between these Terms and any promotion-specific terms or official rules, the promotion-specific terms or official rules will control for that promotion.
All items purchased from PetMeds® are shipped under a shipment contract with a third-party carrier, so risk of loss and title pass to you when PetMeds delivers items to the carrier, except where prohibited by law or where PetMeds states otherwise for a product or shipment. Contact PetMeds promptly if an item is lost, damaged, delayed, temperature-compromised, incorrect, expired, or otherwise unsuitable so PetMeds can review the issue, coordinate with the carrier where appropriate, and determine any available replacement, refund, credit, or other remedy under PetMeds policies and law.
